It would fail anywhere, me thinks. Tis a shame, too. I think the laws for alchohol use should more more of Germanys, though, where yu learn to be a responsible drinker before driving...
Anywho, the whole spam business is hardly going to cut down. The location of the countries selling and sending are scattered all over the world, usually with servers in other continents where laws in either the UK or US for that matter can't touch them.
Hence, we're stuck with spam. Anyways, as far as I know, it would still be completely legal to spam somebody if their email information was harvested off somewhere where there was either no privacy policy or the privacy policy discretely leaves out any restictions against sharing emails with other "partners".
