If that were true, Bram Cohen would be liable to pay fines for every single film downloaded via BitTorrent. There's nothing legally or ethically wrong with using BitTorrent software; it just depends what you use it for.
As for baiting their users; that's rubbish. CBS as a content provider were probably completely oblivious to what was being provided by C|NET. And even if they were aware that BitTorrent software was being hosted by their subsidiary, it's a very long bow to draw to imply that that means they were baiting consumers to take part in piracy.
