Newton's theory? *smirks but says nothing*
Evolution as Darwin presented it is not held by most...um...I guess they'd be biologists, but science agrees he got the basic principle right. The trouble is, fossil evidence shows that evolution happens in 'bounds'. I saw a program on it, but I wasn't paying attention. But yes, the whole thing is only a theory.
And as for why are there still apes today? Well, firstly it's worth mentioning that humans are classified as apes, so your confusion is only based on lack of knowledge. But yes, all apes today apparently evolved from a common ancestor, just as all hominids today evolved from a common ancestor.
