You can't ban published works in the United States -- it's unconstitutional. There are a few very narrow exceptions, none of which apply to this scenario. Other countries could ban it -- I know Australia banned GTA3 -- but the US or individual states in the US could not. States can pass laws to make it very difficult for kids to get their hands on it, but it they can't ban it outright.
Whether a publisher would touch it is a whole different story, and I agree if the violence is too graphic or gratuitous, a lot of publishers wouldn't. Distributors can also refuse to distribute it; stores can refuse to carry it; the offended masses can refuse to buy it. That's different. It's obviously a difference of opinion, but I'm having trouble seeing how this is any worse than GTA3 or any of several other games already on the market. This kind of subject matter is in the movies and on TV every day.
