Banner rules: The mistake

After looking at the rules for a banner I discovered something interesting.
This line appears in the Rules dictating a banner in a signature:
"The image size must not exceed 35kb or 35000 bytes"

There are not 1000 bytes to a kilobyte, in fact there are: 210 or 1024.
So that means:

35kb = 35840 bytes
35000bytes = 34.18kb

And as you can plainly see:
35kb ‚ 34.18kb
Don't know if you can see that symbol. It means "does not equal"

So, which is the maximum size?
(Well, what I realy want to know who screwed up)
