Unauthorized usage of a domain... can I stop this?

Dragadon's topic about spammers prompted me to post this, and see if anyone has any advice for me.

As you all know, my domain is www.oddworld.au.com. With my domain I have a feature where any email that is sent to the domain is sent to me. Therefore, I recently found out about a nasty trick that a spammer was using when one of their emails bounced back.

A spammer was actually using my domain as their "from" address when they sent their emails out (something like refinance9332@oddworld.au.com). The email they sent asked people to visit a website, therefore no reply address was needed, so they decided to use mine!

Now, is there a way that I can protect my domain name. I don't want to have spam mail sent out from it, not only does it give my site a bad name, it also could get my domain name blacklisted from some ISPs if people were to report it.

One would think that once you own a domain, it is your property. But I don't know where to start looking, so I was hoping someone might have a suggestion.

If spamming was legal then using someone else's domain name would be illegal.
*remembers that it's legal in the EU*
*hates whoever it is that isn't making it illegal*

Spamming isn't regulated therefore there's no one to complain to.

What do you mean by blacklisted? What will ISPs do to you if you're blacklisted?

I think what it means by 'blacklisted' is that the ISPs put you as one of the least desireable sites to visit and don't put you on the search engine lists.
That's my guess anyway...I could be way off.
