Absolutely correct. But the army claims that Guantanamo is not USA sovereign soil (they're officially settled on Cuban land) so the constitution does not count. *sigh*

Except that no country has a 100% accurate conviction rate. Punishments must be humane to cater for the possibility that someone innocent has been convicted.
Even for people who are clearly guilty, we must remain humane otherwise we'll be stepping back into the dark ages. |
